Sand Springs Police to uphold Appellate Court decision legalizing female toplessness in public places

Public female toplessness has recently taken social media by storm following a 10th Circuit Court of Appeals ruling that initially appeared to legalize it in the six states under the Court’s jurisdiction. Now the waters have been muddied regarding where exactly the laws have changed.

In 2015 the City of Fort Collins, Colorado enacted an ordinance restricting public female toplessness, leading Brittiany Hoagland and Samantha Six to sue the City on behalf of the “Free the Nipple” movement. A district court sided with the plaintiffs in 2017, and the City appealed the decision. On February 15th, 2019, the 10th Circuit Court of Appeals upheld the district court’s decision in a 2-1 vote.

In Free the Nipple v. City of Fort Collins, Circuit Judge Gregory A. Phillips states “we recognize that ours is a minority viewpoint. Most other courts, including a recent (split) Seventh Circuit panel, have rejected equal-protection challenges to female-only toplessness bans…None of these decisions binds us, though; nor does their sheer volume sway our analysis.” Judge Mary Beck Briscoe sided with Phillips.

Circuit Judge Harris L. Hartz wrote a dissenting opinion, saying the Fort Collins ordinance “does not discriminate against women on the basis of any overbroad generalization about their perceived ‘talents, capacities, or preferences.’ To the extent it distinguishes between the sexes, it is based on inherent biological morphological differences between them.”

Though the court’s opinion was rendered in February, it didn’t go viral till September when Fort Collins decided not to appeal the decision to the Supreme Court. The City had already spent more than $300,000 defending the ordinance, and did not want to spend additional public funds on a case they weren’t sure they would win.

“Free the Nipple” advocates have claimed that the ruling, and Fort Collins’s subsequent decision not to appeal it, in effect legalized public female toplessness in Oklahoma, Kansas, New Mexico, Colorado, Wyoming, and Utah, as well as portions of Yellowstone National Park extending into Montana and Idaho.

In reality, it’s not that cut and dry. Individual ordinances will still need to be challenged at the state and municipal levels, and local governments have the ability to continue enforcing those ordinances until they are ordered by the courts to stop.

The Oklahoma City Police Department issued a statement saying that they “will continue to enforce the law as outlined by City Ordinance and State Law as this preliminary injunction issued by the 10th Circuit Court is in reference to an appeal specific to the City of Ft. Collins in Colorado. Therefore, someone in OKC who is in violation of the law could be city and/or jailed as this is a misdemeanor crime.”

On the other hand, the Tulsa Police Department initially stated that the court decision did apply, and they would not be arresting or ticketing women who went topless in public areas. The Tulsa County Sheriffs Department also stated they would abide by the court’s ruling, even allowing toplessness at the Tulsa State Fair, since it is a public event.

On Monday, Oklahoma Attorney General Mike Hunter released a statement saying that “the ruling does not automatically invalidate local and state laws in Oklahoma.”

"The Tenth Circuit’s preliminary decision in the Fort Collins case – a case that has now ended without a full adjudication – does not change local and state laws in Oklahoma on the subject,” Attorney General Hunter said. “The majority of courts around the country that have examined this issue have upheld traditional public decency and public nudity laws. These courts have recognized that states and political subdivisions have a legitimate interest in prohibiting public nudity as traditionally defined."

Hunter cited a May ruling by the 8th Circuit Court of Appeals that upheld a similar ordinance in Springfield, Missouri, and a 2017 ruling by the 7th Circuit Court of Appeals that upheld a similar ordinance in Chicago, Illinois.

“The 10th Circuit’s ruling made preliminary conclusions about the Fort Collins ordinance, but did not decide the law’s ultimate constitutionality. Because the Fort Collins ordinance was repealed, the 10th Circuit’s ruling likely cannot be appealed to the U.S. Supreme Court. In conclusion, the 10th Circuit’s ruling is not binding on Oklahoma state courts.”

Following Hunter’s statement, the Tulsa Police Department changed course, but not before dozens of women skated topless down the Riverside trail system Sunday evening. The department said, following AG Hunter’s guidance, they will continue to ticket or arrest women who go topless in public.

The Sand Springs Police Department, however, will continue to abide by the Appellate Court’s decision, according to Police Chief Mike Carter. Carter provided Sandite Pride News with the following statement Monday evening at 7:30 p.m.

“We respect the authority and jurisdiction of the 10th Circuit which covers the State of Oklahoma. If we encounter situations where the conduct crosses the line to be in a lewd and lascivious manner, we will still enforce the state statues or city ordinance. If the conduct is not done with the intent of being obscene or sexual in nature, we will not as the Court has ruled that women have an equal protection under the law. We hope that this is a passing issue as we would like to concentrate our time and effort on crimes that are worthy of our attention.”

For now, women seeking to go topless in public should reach out to their local police department to find out if local or state ordinances will be enforced. Additionally, displaying the breasts in a non-sexual manner may be protected in some areas, especially in regards to breastfeeding, but sexual activities will likely violate public lewdness laws in most jurisdictions.

There is currently a lawsuit pending before the United States Supreme Court, challenging a ban on topless women in New Hampshire. The Court has yet to announce if it will hear the case.

Great Raft Race to launch in Sand Springs Monday morning

The 24th Annual Great Tulsa Raft Race will be launching from Case Community Park in Sand Springs Monday, September 2nd beginning at 8:00 a.m. Hundreds of uniquely crafted homemade rafts will take to the waters of the Arkansas River in a race to Tulsa’s River West Festival Park.

The iconic showcase of Tulsa ingenuity first ran from 1973 through 1991 before being discontinued, and was resurrected by the Tulsa Young Professional Foundation in 2015 with overwhelming success.

Kayaks, canoes, inflatable rafts, and homemade rafts float approximately eight miles in a timed race. While competitive rafters enjoy the exhilarating race to the finish line, most spectators are entranced by the unique floats showcased in the design challenge. Awards are presented for Best of Show, Best Engineered, and Most Creative, in addition to the timed race winners.

While many families prefer the ease of sleeping in and catching the final leg of the race in Tulsa, there are exciting perks to watching the show bright and early in Sand Springs. Many of the more kooky and creative rafts won’t make it to Tulsa due to poor engineering. Some of the neatest aesthetic designs are crafted without proper expertise in seaworthiness, and won’t even make it off the Sand Springs boat ramp without sinking. Every year fan-favorites hit the river and immediately begin taking on water - leading to a mad dash by the rafters to bail water and corral their vessel to the shore before it is submerged.

Only a few hundred viewers are treated to this sight as most of Sand Springs’s fans watch from the Highway 97 Arkansas River bridge instead of journeying into the park. However, there is plenty of room in the park for onlookers, and the Sand Springs Parks Department will have bleachers set up near the launch point. The River City Trail that runs through the park also has several great viewing locations downstream from the launch point, and one of the best spots to get right up on the water is beneath the Highway 97 bridge on either the north or south sides of the river.

The northbound bridge over the river does have a pedestrian path that is safe from traffic, and in past years the Sand Springs Police and Fire Departments have narrowed the southbound bridge to a single lane to ensure the safety of onlookers watching from the shoulder of the highway.

The best views, however, can be found at ground-level from the shoreline, and there is easy access with plenty of shade in Case Park beneath the bridges. Case Park will also offering free parking at the soccer and baseball complexes, whereas the Finish Line Festival in Tulsa charges $10 to park.

Launches will last from 8:00 a.m. to 11:30 a.m. in Sand Springs, and rafts will be arriving at River West Festival Park from 10:30 a.m. to 5:00 p.m. The earliest arrivals will be the kayaks and speed racers, while those who build large lumbering contraptions may take longer to make their way downstream. There will be food trucks and concessions, as well as music from DJ Connection in Sand Springs.

At the Finish Line Festival there will be inflatables for the kids, as well as a Cardboard Regatta raft competition and a Sand Castle Exhibition. Yard games will be set up throughout the park and tournaments will be held in corn-hole and volleyball. There will food trucks, retail and nonprofit vendors, a Conquer the Gauntlet Youth Obstacle Course, kayak rentals, live music, and even $40 helicopter rides.

The Speed Awards will be presented at 12:00 p.m. and the Design Awards will be presented at 4:30 p.m.

Project Director selected for 1921 Race Massacre Centennial Commission

State Senator Kevin Matthews, Chair of the 1921 Race Massacre Centennial Commission, announced Friday that Tulsan Phil Armstrong had been chosen to serve as project director. The Commission will facilitate actions, activities, and events that commemorate and educate citizens in Oklahoma and throughout the nation about the history surrounding the 1921 Tulsa Race Massacre in an area that was once known as the nation’s Black Wall Street.

The Commission named Armstrong after a detailed selection process from a pool of 28 applicants, with five finalists appearing before a panel consisting of the Commission’s sub-committee chairs for in-depth personal interviews.

“As project director, Phil will work with the Commission, its subcommittees and key Greenwood District organizations to execute plans for the upcoming 100th anniversary of the Tulsa Race Massacre,” Matthews said.  “I’m very pleased with Phil’s selection and I know he will do an excellent job on behalf of the Commission.”

Matthews said Armstrong has a varied background in the corporate sector and as an entrepreneur in the restaurant business.  A native of Ohio, Armstrong has made Tulsa his home for more than 20 years and has been actively engaged in the community by serving on several non-profit boards, including the Barthelmes School for Music, Community Service Council, Reading Partners of Tulsa and as chairman of the board for the Greenwood Cultural Center.

Armstrong holds a bachelor’s degree in mass communications from Central State University in Wilberforce, Ohio and a master’s degree in public administration from the University of Akron. A gifted vocalist, Armstrong also sings for several events and organizations in the Tulsa metro, including performing the National Anthem for the Tulsa Drillers and Tulsa Roughnecks home games.

2019 Meet the Sandites Photo Gallery

Charles Page High School held its annual Meet the Sandites event Thursday afternoon at Veterans Memorial Stadium. The event recognizes fall athletics like Cross Country, Football, Volleyball, Softball, Cheer, and Dance, as well as Band and Color Guard.

Hosted by the Sandite Quarterback Club in conjunction with Sand Springs Youth Football & Cheer, the event allows every single youth football, cheer, and dance team from elementary on up to run through the tunnel and storm the field.

The Church That Matters Tailgate Crew held their first tailgate party of the season prior to the event. The church grills hot dogs, chicken sandwiches, and more prior to every home football game. Each week a different athletic program is selected as the fundraiser recipient. The Sandite Basketball teams raised more than $1,700.

Sand Springs churches hold free back-to-school bash with school supplies and checkups

The Sand Springs Local Church Network hosted its annual Back 2 School Bash Sunday afternoon at the Tulsa Tech Sand Springs campus. The free event is open to the public and offers all kinds of back-to-school items and services.

The Tulsa Lions Club provided cholesterol screenings, BMI checks, blood pressure checks, and vision testing. Children were checked for lice and given free haircuts by licensed professionals. A Better Smile provided free dental screenings. Volunteers from numerous local churches helped to distribute free backpacks and school supplies

In addition to the necessities, fun was also on the menu. Sandlot Sno-Balls, popcorn, balloon animals, and the Tulsa County Reading Roadshow were on hand, as were an ambulance and three classic police cars for the children to explore.

Church That Matters holds community service day, donates children's bicycles to flood victims

Members of Church That Matters held their annual “Don’t Go to Church Sunday” this weekend and spent the day in service to the community.

Volunteers worked at the Local Church Network’s Back to School Bash, organizing, setting up, operating, and tearing down the event at the Tulsa Technology Center Sand Springs campus. The event provided free backpacks and school supplies, haircuts, dental checks, physicals, eye exams, food, and inflatables.

Church members performed landscaping and weedeating for the Sand Springs Parks Department, Clyde Boyd Middle School, and an elderly couple in Shannon Valley mobile home park. They also constructed a wooden deck for a home in Shannon Valley.

Workers cleaned, painted, and sorted clothing at DaySpring Villa, a shelter for victim of domestic violence and sex trafficking. They also held worship encounters for both the adults and the kids at the shelter, and played games with the children.

Representatives were stationed at Prattville Laundry to provide free quarters and laundry detergent to the laundromat’s patrons. They also offered free quarters at Bubble Town Car Wash.

The church purchased and assembled 150 children’s bicycles for victims of the historic May flooding, which they gave away during a special service held specifically for flood-affected families. They also organized a community swap meet Saturday, accepting and organizing hundreds of furniture and appliance donations for flooded families.

Church That Matters meets Sundays at 9:30 a.m. and 11:00 a.m. at 3 West 41st Street in Sand Springs. They are pastored by Rusty Gunn.
